Terms of Service

These Terms govern your use of the Axively service operated by DEBRUSK s.r.o. By creating an account or running a scan, you agree to these Terms.
1. The service
Axively is an accessibility audit service that scans publicly accessible web pages against WCAG 2.2 AA and EN 301 549, produces remediation suggestions, and generates compliance statements. Automated testing cannot detect every accessibility barrier; a complete assessment always requires manual expert review. Axively does not constitute legal advice and does not guarantee compliance with any law or standard.
2. Eligibility
You must be at least 16 years old and authorised to bind your organisation. You may only scan websites you own, operate, or have written permission to test.
3. Acceptable use
You must not: (a) scan sites you do not have permission to test, (b) overwhelm the service with excessive requests, (c) attempt to reverse engineer the AI models, (d) resell or sublicense the service without a written agreement. Abuse may result in immediate account termination.
4. Fees and billing
Axively is sold as a one-time audit, priced by the number of pages scanned; there are no subscriptions and no auto-renewal. Payments are processed by Polar (polar.sh), which acts as the Merchant of Record for every purchase. This means Polar is the reseller and the contracting party for the sale: Polar processes the payment, calculates, collects and remits any applicable VAT or sales tax, and issues the invoice or receipt. The price is shown before purchase; we never receive or store your full card details.
5. Refunds and right of withdrawal
The website scan and the follow-up audit (AI fix suggestions) are separate digital services performed immediately, so each is treated as fully performed once it completes. By ordering and paying for the scan, or the audit, you expressly ask us to begin performing that service without delay, before the statutory 14-day withdrawal period expires, and you acknowledge that you thereby lose your right of withdrawal. Because we make the results available to you before that period expires, the statutory right of withdrawal under § 1837 of the Czech Civil Code and Article 16 of Directive 2011/83/EU no longer applies once the service has begun, unless you are exercising rights arising from defective performance. If we fail to deliver a service – for example a scan that cannot be completed – you are entitled to a full refund of the relevant payment. Refund requests are handled by Polar as Merchant of Record: contact support@axively.com and we will arrange the refund. This clause does not affect your mandatory statutory rights as a consumer.
6. Your content
You retain all rights to the websites and content you submit. You grant us a limited license to process that content solely to deliver the service. Scan reports belong to you; you may share, export and publish them freely.
7. Our content
The Axively platform, interface, brand and documentation are our intellectual property. AI-generated fix suggestions are provided on a "best-effort" basis; you are responsible for testing and deploying them.
8. Warranties and liability
The service is provided "as is". We do not warrant that scans will detect every issue or that AI-generated fixes are always correct. To the maximum extent permitted by law, our liability is capped at the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or lost-profit damages.
9. Legal advice disclaimer
Axively is not a law firm. Per-country legal exposure information is researched from public sources and kept up to date on a best-effort basis. It does not constitute legal advice. Consult a qualified lawyer for binding interpretations of EAA requirements.
10. Termination
You may delete your account at any time. We may terminate accounts that violate these Terms with 30 days' notice (or immediately for serious breach). Upon termination your scan data is deleted per the retention schedule in the Privacy Policy.
11. Governing law
These Terms are governed by the laws of the Czech Republic. Disputes that cannot be resolved amicably will be submitted to the courts of Prague, Czech Republic. EU consumer law rights are not affected.
12. Changes
We may update these Terms. Material changes will be announced by email at least 30 days in advance. Continued use of the service after the effective date constitutes acceptance.
